Terms of Service
These Terms of Service ("Terms") govern your use of the Empty.cash services ("Service"), accessible via the empty.cash website. Please read these Terms carefully before using our Service. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.
- Order Security and Confidentiality: Your Order ID and order page link are confidential credentials that control access to your order. Anyone possessing this information can request refunds for your order. You are solely responsible for maintaining the confidentiality of these credentials. In case of unauthorized access, refunds will be processed on a first-come, first-served basis. If you suspect your order information has been compromised, immediately create a support ticket through the order page. The Service is not liable for unauthorized refunds resulting from compromised credentials.
- Service Nature and Compliance: The Service operates without Anti-Money Laundering (AML) or Know Your Customer (KYC) procedures. No identity documents or personal information are required. Users are responsible for ensuring their use of the Service complies with applicable laws in their jurisdiction.
- Order Placement and Payment:
• Payment window: 35 minutes from order creation
• Orders not paid within this timeframe are automatically canceled
• The timer stops once any payment is received, regardless of network confirmation status
• Accepted currencies: Bitcoin (BTC) and Ethereum (ETH) - Order Limits:
• Minimum order amount: 0.01 BTC equivalent
• Maximum order amount: No fixed limit, but larger orders may require extended processing time
• Orders are subject to available liquidity - Processing and Delivery Times: Standard processing times after network confirmation:
• BTC: Typically 1-4 hours
• ETH: Typically 2-5 hours
For orders exceeding 1 BTC equivalent, processing time may increase proportionally. These are estimated timeframes and may vary based on network conditions and order volume. - Service Discretion: The Service reserves the right to cancel any order and issue a full refund at its sole discretion. Reasons may include but are not limited to: suspicious activity, technical issues, regulatory concerns, or inability to fulfill the order. Refunds in such cases exclude network transaction fees.
- Network Fees:
• For completed orders: Service covers all network fees
• For refunds: Network fees are deducted from the refund amount
• High fee periods: During extreme network fee spikes (>1000% of average), order processing may be delayed until fees return to normal - Network Confirmations: The Service is not responsible for blockchain network confirmation times. Processing times begin only after your payment receives the required number of network confirmations.
- Refund Eligibility: Refunds may be requested when:
• Partial payment was made and payment timer expired
• Service delivery exceeds 36 hours from payment confirmation
• Service cancels the order
• Technical failures prevent order completion - Refund Processing: Maximum refund processing time is 48 hours from the moment:
• Refund is requested through proper channels, AND
• All incoming transactions are fully confirmed on the network
This timeline applies to all refund scenarios including service refusal, technical failures, maintenance, or suspected fraudulent activity. - Late Refund Compensation: If refunds are not processed within the 48-hour window, users who choose to cancel their order may claim a 0.1% daily fee on the refund amount, calculated from the 49th hour.
- Support and Disputes:
• Support tickets can be created through your order page
• All communication must reference your Order ID
• Dispute resolution is handled exclusively through the support ticket system
Disclaimer of Liability for Incorrect Transactions
We do not accept responsibility for transactions carried out with inaccurate details, such as sending transactions to incorrect addresses, using the wrong networks, or paying incorrect network fees. Additionally, we absolve ourselves of any liability for transactions conducted on domains other than our official service domains.
Eligibility
By using our Services, you represent and warrant that:
- You are at least 18 years of age or the legal age of majority in your jurisdiction.
- You are not located in, a resident of, or subject to the jurisdiction of any state, country, or territory where your use of the Services would be illegal or otherwise violate any applicable law.
You are solely responsible for ensuring that your use of the Services is in compliance with all laws, rules, and regulations applicable to you.
Changes to Terms
We may update these Terms periodically. Any changes will be effective immediately upon posting on our website. It is your responsibility to review these Terms regularly.
Data Policy
Data Collection and Storage
We maintain strict control over the conditions outlined below, ensuring they are consistently applied across all servers within our infrastructure. This includes the software on each individual server, such as web server log files, Linux daemon logs, backups, and databases.
All data described in this policy is stored exclusively on our servers. We do not sell data in any form and refrain from using third-party solutions, even for the purpose of providing user support.
Data Not Stored
- IP Addresses: We do not store your IP address in any form. However, please be aware that your IP address may be stored by network providers at various stages of data packet transmission. For enhanced anonymity, we recommend using the latest version of the Tor Browser and accessing our site through its .onion domain.
- Browser Identifiers: We do not store any identifying data from your browser, such as user-agent strings, font lists, or other browser-specific information.
- User Identification: We do not assign any identification numbers to individual visitors or sessions, and we do not utilize cookies or similar tracking mechanisms in your browser.
Data stored: Order data
The following data is recorded in our system only if order is created by you:
- Auto-increment row number (int)
- Order creation time to the second (date)
- Order expiration time (date)
- Generated internal order identification number (var)
- Generated order URL (var)
- ETH/BTC exchange rate at the time of order creation (decimal)
- Total sum user needs to pay (decimal)
- Status (int)
- Order recipient addresses: parent block (int), address (var), amount of coins (decimal), network identifier (int), delay before sending in seconds (bigint)
- Addresses generated for order payment: address (var), network identifier (int), status (int)
- Incoming and outgoing payments: payment date (date), txid (var), address (var), wallet (int), network confirmations (int), block time (bigint), amount (decimal), fee (decimal), last update time (date)
Data Anonymization: Order data
Once an order reaches its final status (success or expired), a 24-hour countdown is initiated. Upon completion of this countdown, all data that could potentially identify the transaction participants is erased or anonymized as follows:
- Order creation time (date) is rounded to the day
- Order expiration time (date) is rounded to the day
- ETH/BTC exchange rate at the time of order creation is reset to zero
- Order recipient addresses and all associated data are deleted
- Addresses generated for order payment and all associated data are deleted
- All data related to incoming and outgoing payments is deleted
Exception: In the event of payments issues or if a user contacts support regarding a specific order, the data retention period for that order may be extended until all related issues are resolved.
Please note that cryptocurrency transaction data is also stored on the blockchain, which is independent of our platform. To maintain optimal anonymity, we strongly advise against reusing wallet addresses.
The data that remains unchanged, along with the rounding of certain data points, is necessary for maintaining internal statistics and cannot be used to identify individual transaction participants.
Data stored: Support request data
When a user contacts our support team and creates a new ticket, the following data is recorded in our system:
- Auto-increment row number (int)
- Ticket chat time to the second (date)
- Order identifier specified by the user (var)
- Status (int)
- Message text (text)
- Message author role (int)
- Message read status (int)
Data Deletion: Support request data
After a support ticket is marked as solved, a 24-hour countdown begins. Once this countdown concludes, all data associated with the ticket is permanently deleted from our system.
Additionally, users have the option to immediately delete all ticket-related data directly from the ticket page.
Data Sharing
We do not share any user data with third parties.
User Rights
Users have the right to request request the deletion of their data, subject to legal obligations and technical feasibility.
